    Tomorrow Category presidents will meet to seek agreement

    Trying to make sense of LFP case with Real Murcia

    Carlos García looks to make sense of the confusion and controversy, surrounding the situation of Real Murcia and the LFP decision to refuse them entry into the Segunda this season, amidst legal proceedings and arguments from all sides.

    Five days before the start of La Liga, we followed expectantly for news. At 10pm on Monday night, Javier Thebes, president of the Professional Football League (LFP), announced that the timetable for the Spanish Second Division remains as before. Mirandés will host Lugo this weekend, and Real Murcia will do the same with Logroñés in the Segunda B. As Tebas announced, the LFP has filed an opposition to the Writ issued by the Commercial Court of Madrid No. 7 on 12 August.

    There has been much speculation this week about the future of Real Murcia, which, remember, had an administrative relegation to Second Division ‘B’ for failing to meet debt and income ratios required by the statutes of La Liga, in addition to their “repeated” breaches to the Treasury.

    This favoured C.D. Mirandes, who had been relegated to the Spanish third-tier on the final day of last season and take the place of Real Murcia. However as usual, the relevant information has been brief, incorrect and incomplete.

    As stated in the Writ, rarely is the need to adopt a precautionary measure is so evident, because the club is in bankruptcy proceedings, and non-participation in the professional competition would mean a loss of income that would prevent Murcia to meet its creditors. This has been “documentary proof”, as stated in the fifth Legal Basis of the Writ.

    For instance, Real Murcia would lose € 2,5 million for the exploitation of its media rights. The main purpose of the Writ is the protection of creditors involved in the bankruptcy agreement of the club, highlighting main creditor: the Treasury, whose expectations for recovery would be almost depleted if not complied with such an injunction. Curious, considering that the agreement between La Liga and the Treasury to eliminate Spanish clubs debt, for which Javier Tebas has been always shown himself proud.

    If the Writ had been unfavorable, it would have meant the impossibility of implementing a possible estimated failure. That is, could be that if reason is finally given to Real Murcia, it (probably) would have disappeared before it happened. However, the Spanish Football Federation (RFEF) has demanded that the Liga Adelante only commence the season with twenty two, and not twenty three clubs, as has been speculated over the past two or three days. Thus, the LFP will send an opposition to the Writ due to “impossible failure”, as Tebas explained during his appearance.

    Many believe that this is the end of the saga. Nothing is further from reality. Now, two new legal scenarios are open. First, the same judge must issue a new Writ within five working days; secondly, Real Murcia could ask an executive action of the injunction. That is, forcing the LFP to comply with the provisions of the Writ by all possible means. For example, urging officials of La Liga’s Registry not to enroll Mirandés, and instead, say yes to the team of the Nueva Condomina.

    Based on this, this weekend Mirandés will be a Second Division team, but might not be next Tuesday. Hang on… this might get even more complicated yet…
